FaxMingle Terms of Service

1. Eligibility

You must be at least 13 years old to use FaxMingle. By using the Services, you represent that you are 13 or older and have the legal capacity to enter into this agreement. If you are using FaxMingle on behalf of an organization, you confirm that you have authority to bind that entity.

2. Description of Service

FaxMingle provides online fax services allowing users to send faxes via the internet. Users may:

• Send one free fax (subject to reasonable use limits);
• Use a pay-as-you-go option to pay for each fax individually;
• Purchase a subscription plan including a fixed number of fax transmissions per billing period.

Pricing and feature details are available on our website and may be updated periodically. We reserve the right to modify, suspend, or discontinue any portion of the Services at any time without notice.

3. Account Registration

To use certain features, you may need to create an account and provide accurate, complete information including your email address, sender fax/phone number, and recipient fax number. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Acceptable Use

You agree to use the Services only for lawful purposes. You must not:

• Send unsolicited or “junk” faxes;
• Transmit illegal, harmful, or defamatory materials;
• Violate any applicable law or regulation;
• Interfere with, disrupt, or exploit our systems;
• Misrepresent your identity or fax origin.

We reserve the right to suspend or terminate accounts violating these conditions.

5. Fees and Payments

• Free Fax: One-time free fax offer, subject to usage limits. Abuse may result in restriction.
• Pay-As-You-Go: Each fax is billed individually at the current posted rate. Payment is due at the time of sending.
• Subscription Plans: Include a set number of fax transmissions per billing cycle. Unused faxes may expire at the end of each cycle unless stated otherwise.

Payments are securely processed by third-party providers; FaxMingle does not store full card details. Subscriptions renew automatically unless canceled before renewal. Except where required by law, payments are non-refundable once service is rendered.

6. Fax Delivery and Storage

We make reasonable efforts to deliver your faxes but cannot guarantee success due to factors beyond our control (e.g., busy signals or recipient errors). Fax content may be temporarily stored for processing and deleted automatically after delivery or after 30 days. You are responsible for keeping copies of your own faxes.

7. Service Availability

We strive for consistent uptime, but maintenance, upgrades, or external network issues may cause temporary interruptions. FaxMingle is not responsible for downtime caused by carriers, technical failures, or other events beyond our control.

8. Intellectual Property

All content and software on https://faxmingle.com are owned or licensed by FaxMingle and protected by intellectual property laws. You may not copy or redistribute our materials without permission. You retain ownership of documents and faxes you transmit through the Service.

9. Termination

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or misuse the Services. Upon termination, your right to use the Services ends immediately, and any stored faxes may be deleted according to our retention policy.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. FaxMingle MAKES NO GUARANTEES ABOUT SERVICE PERFORMANCE, DELIVERY SUCCESS, OR FITNESS FOR A PARTICULAR PURPOSE. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FaxMingle AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE THREE (3) MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless FaxMingle and its affiliates from any claims, damages, or expenses resulting from your use of the Services or violation of these Terms.

13. Changes to These Terms

We may update these Terms at any time by posting a new version on our website. Continued use after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of [Your State], without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts in that state.
